Data protection declaration for applicants in accordance with Art. 13, 14 GDPR – fulfilment of information obligations

With this data protection declaration, Saubermacher Dienstleistungs AG (hereinafter “SDAG”) fulfils its obligation to inform you about the processing of your personal data using the “BITE” tool during the application process.

Saubermacher Dienstleistungs AG is a steadily growing group conglomerate. The companies listed at11 are legally independent holdings of SDAG or companies that are contractually affiliated with SDAG. We process the personal data of applicants on behalf of our subsidiaries

2 Authorisation concept

At SDAG, we have developed a strict authorisation concept for all persons who work with personal data. Data is accessed exclusively according to the need-to-know principle. In each company, only a few employees are authorised to access the personal data of applicants. Your data will be made available to the responsible employees in the HR department and the responsible employees or supervisors in the specialised department(s) as well as participations for the position for which the applicant has applied.

3 Processor BITE

We use the applicant management system implemented on our website by BITE GmbH, Magirus-Deutz-Straße 12, 89077 Ulm, Germany (hereinafter “BITE”) for the application process (advertisement, processing of applications, communication with applicants, administration and record keeping of applications).

All applications to SDAG are processed via the BITE applicant management system. You have the option of uploading your application documents directly as part of the online application in the respective job advert. This will register you as an applicant and your documents will be saved and processed. Alternatively, you can also apply by e-mail. In this case, we will also register you as an applicant in BITE and save and process your documents there. If you submit your application in paper form, we will scan your documents, record them in BITE and process your application documents there.

Within the scope of these activities, BITE processes personal data solely on behalf of and for the purposes of SDAG and is therefore a so-called processor within the meaning of Art. 4 (8) GDPR. A corresponding contract has been concluded between Saubermacher Dienstleistungs AG and BITE.

4 Data processing

4.1 Persons concerned

Data subjects are persons who apply as candidates for a vacant position advertised by SDAG itself or a participating interest. In addition, persons who submit unsolicited applications.

4.2 Processed data categories

The following data is processed in the recruitment process if you provide it:

  • Salutation and name data (first name and surname)
  • Address and contact details (e.g. address, telephone number, e-mail address)
  • Application documents (e.g. CV, letter of motivation and, if applicable, certificates, application photo)
  • Education data (e.g. information on school or university degrees)
  • Activities from previous employment (e.g. certificate of employment)
  • Job requirements (e.g. job profile, job description, desired scope of employment, notice period, salary expectations)
  • Other skills and qualifications (e.g. additional training, certificates, languages or hobbies)
  • Files and documents that you upload voluntarily

The application process can be interrupted at any time by pressing the pause symbol and continued at a later time. To do this, enter your e-mail address and optionally a password of your choice to save the status of your application. The process can be continued within 29 days via a link provided

In addition, written and electronic communication between you and the respective recipients will be stored. They also process comments and evaluations that are written about you as part of the application process.

4.2.1 Forwarding of data

The data will be made available to the responsible employees of the HR department and the responsible employees or supervisors of the specialist department(s) and holdings for the position for which the applicant has applied. If it is an unsolicited application, the documents will be made available to the responsible employees of the HR department and the responsible employees or supervisors of the relevant specialist departments and holdings for which the application may be of interest.

4.2.2 Data processing by BITE

The following usage data is automatically collected by BITE:

  • IP address
  • Date, time and duration of access
  • Browser and metadata

This data is technically necessary to provide the functions of the applicant management system and to ensure its stability and security. The data will be deleted as soon as the services associated with the data have ended and the data is no longer required for the above-mentioned purpose.

5 Purpose of data processing

5.1 Purpose

Your personal data will be processed for the purposes of personnel selection and to fill vacancies.

5.2 Legal bases

The transmission of your data in the course of your application is based on a pre-contractual relationship.

Legal basis: Art. 6 para. 1 lit. b GDPR (contract initiation and fulfilment)

Your data will be processed on the basis of your consent if you explicitly agree to your application documents being kept on file.

Legal basis: Art. 6 para. 1 lit. a GDPR (consent)

In certain cases, we process your data to protect our own legitimate interests. A legitimate interest exists, for example, if data is required for the exercise or defence of legal claims in the context of the application process (e.g. due to a legal dispute based on possible discrimination). In the event of a legal dispute, we have a legitimate interest in processing the data for evidence purposes.

6 Data deletion

If you have applied for an advertised position, your data will generally be stored for 7 months after your application has been rejected. If you give your consent, your data will also be stored for 7 months for the purpose of keeping records and for further consideration and contact in the event of future suitable vacancies.

7 WhatsApp application

In addition to a speculative application, you also have the option of applying on our website via the WhatsApp service. Provided by the service operators of BITE GmbH, Magirus-Deutz-Straße 12, 89077 Ulm, Germany or WhatsApp Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland. By clicking on the “WhatsApp Application” button, the WhatsApp API environment is opened and the application process is started by means of a digital recruiting assistant via BITE GmbH. The assistant runs exclusively on BITE GmbH’s own servers, so no personal data is forwarded to WhatsApp.

8 Credit reports

When advertising certain positions, we reserve the right to obtain credit information about you from CRIF GmbH, Rothschildplatz 3/Top 3.06.B, 1020 Vienna, Austria, for a fee.

9 Your rights

You have the following rights vis-à-vis us with regard to your personal data:

  • Right to information, rectification and erasure
  • Right to restriction of processing
  • Right to object to the processing

10 Consent and revocation

If you have given your consent to the processing of your personal data, you can revoke this at any time. The revocation of your consent is effective for the future. If you revoke your consent, your personal data collected in this context will be processed to answer your enquiry. Your personal data will be processed to fulfil a legal obligation on the basis of Art. 6 para. 1 lit. c GDPR.

11 Changes to this privacy policy

We reserve the right to make changes to our privacy policy from time to time. We will publish all changes to the privacy policy on this page. Please refer to the latest version of our privacy policy in this regard.
